Force Majeure不可抗力: Neither party shall be liable for a delay in its performance of its obligations and responsibilities under this Agreement due to causes beyond its control such as, but not limited to, war, strikes or lockouts, embargo, national emergency, insurrection or riot, acts of the public enemy, fire, flood or other natural disaster, provided that said party has taken reasonable measures to notify the other in writing of the delay and its anticipated duration. Failure of subcontractors and inability to obtain materials shall not be considered as force majeure delays. 任何一方当事人由于非其所能控制的因由,例如,但不限于,战争、罢工或关闭工作场地、禁运、国家紧急状况、暴动或骚乱、公敌的行为、火灾、洪水或其他自然灾害,延迟履行其根据本协议承担的义务和职责,只要该当事人已经采取合理的措施,将发生的延迟及其预计持续时间以书面形式通知对方,该当事人无须对该延迟承担责任。分包人不履约以及无法获得物料不应当被视为不可抗力导致的延迟。
